Arkos is a Delaware corporation with headquarters located at 40 West Baseline Road Suite #112, Tempe, AZ 85283. Arkos provides the Site subject to the Terms of Use (“Terms”) below.

Such revisions shall be effective immediately upon being posted to the Site and will govern the relationship between you and Arkos with respect to your use of the Site. • PURPOSE & LICENSE—The Site is a general purpose website that provides information about Arkos and its services. Arkos does not sell or deliver services through the Site. You may not order or contract with Arkos through the Site. Subject to your compliance with these Terms, Arkos grants you a personal, non-exclusive, non-transferrable, limited privilege to access and use the Site solely for informational purposes. We may revoke your access and use of the Site at any time.

• LINKS—The Site may include links to third party websites and content. These links are provided for your convenience and do not carry any specific endorsement or warranty. You agree that Arkos shall not be responsible for any loss or damage of any kind incurred because of your access or use of these websites. Arkos does not monitor or review the content of such third party websites and you acknowledge and agree that We:

• CONTENT—We attempt to ensure that information on the Site is complete, accurate and up to date. However, We make no representation or warranty as to the completeness or accuracy of any information on the Site.

Nothing contained on the Site is a license or right to use any element of the Site without the express written permission of Arkos or applicable third party owner.

• YOUR PERSONAL INFORMATION— You can access and browse Arkos’ Site without disclosing your personal information. We only collect the personal information that you choose to volunteer in connection with requests to receive communication and/or information from Arkos. You hereby agree to Arkos’s Privacy Policy – please read our Privacy Policy carefully to understand how we collect and use your information. Arkos will not be liable for any improper use or disclosure of personal information you choose to provide on the Site that is not caused by Arkos’ intentional misconduct.

• EMAIL CORRESPONDENCE—Arkos will use reasonable means to maintain the privacy and confidentiality of any requested email correspondence. However, Arkos will not be liable in the event that you or anyone else inappropriately uses your email. If you decide to use email to communicate with Arkos, you should be aware of the following risks and/or your responsibilities:

  3. If you provide an employer-issued email account to communicate with Arkos, you understand and agree that your employer may have the right to access all email sent thereto.

• APPLICABLE LAW—Arkos controls its Site from its offices in Pittsburgh, Pennsylvania, USA. By accessing the Site, regardless of where you are located, you agree that the statutes and laws of the Commonwealth of Pennsylvania will apply to all matters regarding the use of our Site. The Site is not intended to subject Arkos to the laws or jurisdiction of any state, country, or territory other than those, as applicable, in Pittsburgh, Pennsylvania, USA.

• WAIVER & ENTIRETY—Arkos’ failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms and our Privacy Policy comprise the entire agreement between you and Arkos with respect to the Site and supersede all prior and contemporaneous agreements or understandings.
